Is this example of "zina" law in Pakistan really part of Islam? Is it Shariah Law? (details)?

"Fifteen-year-old Jehan Mina became pregnant after being raped by her uncle and cousin. Her family filed a complaint of rape but since there were no witnesses, the alleged rapists were acquitted. Yet her pregnancy was proof that "zina" [extra-marital sexual intercourse] had taken place and she was sentenced to 100 lashes in public. Is this really Shariah Law, according to Koran, hadith, interpretation?

That probably follows for if someone really fornicated but since there was no evidence that the lunatics raped her, it was, I guess, considered fornication and hence, the punishment was given to her. Actually, though, I have never heard of anyone in Pakistan getting lashed in public so I think your information is wrong. Her stupid family might have lashed her though or if she lives in a tribe, the tribal govt. might have. But it's not the national law. The govt. doesn't care about adultery, etc. If these lashings/hangings occur, it's not the govt. that's involved. It's the society....the people around the area.
  4. No this is not correct in shariah law at all. Rape is NOT a crime of the one who was raped. Rape is a crime of the one who did the rape. As far as the two being acquitted....unfortunately rape is hard to prove and often (worldwide) rapists go free.

I don't think the answerer above me (Sam) is entirely correct, as this 'zina' law is greatly feared by women and many women who have been raped and become pregnant are imprisoned, with their children, for this 'crime'. There is also quite a lot of documentary evidence supporting the existence of these laws and the punishments handed out by the state. One of the gretaest criticisms of Benazir Bhutto's time as PM was that she had the power to revoke these laws and did not, despite having spoken against them at times. This is not a simple matter and it is obvious from reading some of the material on the websites below that the lawz are often misused and are perhaps retained precisely because they allow the state and men a great deal of control over women. However, are they specifically Muslim (or sharia)? That I don't know. Pakistan is a muslim country BUT other muslim countries don't have these laws, so I would say they are Pakistani more than Muslim, although perhaps they are presented as Muslim (sharia) in order to make people feel they are right and good.   7. This is clear breaking of Islamic rules which requires 4 witnesses to the adultry for the penalty of adultry to take place. Also she must do it willingfully. Those who accuse a woman of adultry with no proof are lashed 80 times. There is a general rule in all Islamic penalties that if there is the least doubt that the crime took place , the punishment is not performed.This is obviously not what happens in Pakistan and Iran. Read the verses from the Quran: "The adulterer and the adulteress, scourge ye each one of them (with) a hundred stripes. And let not pity for the twain withhold you from obedience to Allah, if ye believe in Allah and the Last Day. And let a party of believers witness their punishment. (2) The adulterer shall not marry save an adulteress or an idolatress, and the adulteress none shall marry save an adulterer or an idolater. All that is forbidden unto believers. (3) And those who accuse honourable women but bring not four witnesses, scourge them (with) eighty stripes and never (afterward) accept their testimony - They indeed are evil-doers - (4) Save those who afterward repent and make amends.   8. NO NO NO NO. This is NOT ISLAM, i repeat THIS IS NOT ISLAM. The Person who is raped is a VICTIM. The Raper is the one who should be punished.
